Construction Law


Leveraging first-hand knowledge gleaned from years working as a tradesman, Richard has found his niche in Construction Law, which forms the majority of his practice. Hailed by the Tampa Managing Partner of Florida's preeminent construction law firm as "The Lien King," he is able to prosecute or defend any legal action arising from a construction payment dispute, and has advised clients at all stages from contract negotiation through appellate review. 


Additionally, Richard has given presentations qualifying for continuing professional education credits related to AIA standard form agreements, and has represented numerous clients in the negotiation and revision of form agreements, in addition to drafting, reviewing, and redlining non-standard construction agreements.


Finally, Richard has a wealth of experience both prosecuting and defending claims related to construction defects, using his experience in the trades in combination with his legal acumen to develop the best and most streamlined strategies in furtherance of his client's goals.


Commercial Litigation


It's not just hammers and nails - in addition to construction business disputes, Richard has successfully defended dozens of individuals and entities against claims of professional malpractice, has prosecuted dozens of claims for breach of contract (among other equitable theories), and has even prosecuted claims for violations of Florida and Federal securities law.


Property Insurance


Richard leverages his unique knowledge of construction practice and the law associated with it in his prosecution of lawsuits for non-payment of disaster expenses by insurance companies. In addition to his construction knowledge, Richard spent a large portion of his early practice working on behalf of the insurance carriers, learning the standard operating procedures associated with their denial and defense of claims.


Using this knowledge, including the knowledge of carrier pressure points, Richard effectively prosecutes property insurance claims, doggedly running down the denying carriers and their appointed attorneys in avoidance of their third dreaded "D" - delay.


Criminal Law


In addition to his services as a civil litigator, Richard is passionate about defending individuals from allegations that seek to deprive them of their right to liberty, however, only takes on criminal cases on a select basis. While an intern at the Office of the Public Defender for the Fifteenth Judicial Circuit, the elected Public Defender for Palm Beach County, Carey Haughwout confided in Richard that he was the only intern that ever worked in the Circuit that came personally recommended by another elected Public Defender: in this case, Julianne Holt, the elected Public Defender for Hillsborough County. Richard met Ms. Holt while delivering a demonstration on trial closing argument to the Tampa Bay Inn of Court, where over two hundred attorneys and judges were able to obtain continuing legal education credits. In that vein, Criminal Defense allows Richard to pursue his most fiery passion - courtroom and trial advocacy.
